INFORMATION FOR THE CONTRACTORS OF “ATF – HEAVY TRANSPORT” ADAM FIJAŁ (PERSONAL DATA)

Pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing f personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) we inform that:

1. Adam Fijał running his economic activity under the name “ATF – HEAVY TRANSPORT” ADAM FIJAŁ, address of the principal place where economic activity is carried out: ul. 2. Your personal data shall be processed by the Controller in order to conclude and perform the contract to which you are a party.

3. The legal basis for the processing of your personal data shall be:
a. Article 6.1. (b) of the GDPR, which means that the processing is necessary to perform the contract to which you are a party,
b. Article 6.1. (c) of the GDPR, which means that processing is necessary for compliance with legal obligations to which the Controller is subject, including those arising from Article 74.2.4. of the Accounting Act and regarding the storage of accounting documents.

4. The legal basis for processing of your personal data shall be also:
a. Article 6.1. (f) of the GDPR, which means that processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party; the legitimate interests include: establishment, exercise or defence of legal claims, as well as direct marketing,
b. Article 6.1.(a) of the GDPR which means that you have given your consent to the processing of your personal data, in particular in connection with conducting by the Controller the marketing activities using electronic means of communication (email, telephone).

5. Providing your personal data is voluntary, but necessary to perform the contract to which you are a party – the consequence of not providing data may be the inability to conclude and perform the contract. It does not apply to personal data processed on the basis of your consent – in such case there are no consequences of failure to provide this data.

6. The recipient of your personal data: entities providing electronic mail hosting services, entities providing IT services, entities providing consultancy services for the Controller, including legal, tax, auditing advice, other Controller’s contractors, in particular where providing such data is necessary to perform the contract or other activities in the field of economic activity carried out by the Controller.

7. Your personal data shall be processed by the Controller throughout the entire term of the contract, and may also be processed later, i.e. until the expiry of the limitation period for any claims and in connection with the implementation of the 5-year archiving obligation regarding documents stored for tax purposes. Your personal data processed for marketing purposes will be processed for the duration of marketing campaigns, no longer than until the consent is withdrawn (if the basis for processing is consent) or until you object to data processing (if the basis for processing is the Administrator’s legitimate interest).

8. You have the right to request:
a. access to your personal data,
b. rectification of your personal data,
c. erasure of your personal data (the right to be forgotten),
d. restriction of your personal data,
e. portability of your personal data if the processing is carried out by automated means.

9. If processing of personal data is based on the legitimate interests pursued by the Controller or by a third party, you have the right to object to processing your personal data on grounds relating to your particular situation.

10. If your personal data is processed under your consent, you also have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

11. You have the right to lodge a complaint with a supervisory authority – in Poland it’s: the President of the Data Protection Office.

12. There will be no automated decision-making, including profiling, as regards to your personal data.

INFORMATION FOR THE CONTACT PERSONS ACTING ON BEHALF OF THE CONTRACTORS OF “ATF – HEAVY TRANSPORT” ADAM FIJAŁ (PERSONAL DATA)

Pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing f personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) we inform that:

2. Your personal data are being received from you or was provided by your employer/principal for the purposes of conducting cooperation or performing the contract concluded between the Controller and your employer/principal.

3. The Controller receives the following data: basic personal data (name, surname), personal data of the entity you represent, your job position, your business contact details (phone number, email address).

4. Your personal data shall be processed in accordance with Article 6.1. (f) of the GDPR – which means that processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party; the legitimate interests include: conducting cooperation or performing the contract concluded between the Controller and your employer/principal, direct marketing as well as the establishment, exercise or defence of legal claims.

5. Your personal data shall be processed also in accordance with Article 6.1. (a) of the GDPR – which means that you have given your consent to the processing of your personal data, in particular in connection with conducting by the Controller the marketing activities using electronic means of communication (email, telephone).

6. Providing your personal data is voluntary, but necessary to conduct cooperation or perform the contract concluded between the Controller and your employer/principal. Refusal to provide personal data may hinder cooperation or performance of the contract referred to in the previous sentence. It does not apply to personal data processed on the basis of your consent – in such case there are no consequences of failure to provide this data.

7. The recipient of your personal data: entities providing electronic mail hosting services, entities providing IT services, entities providing consultancy services for the Controller, including legal, tax, auditing advice, other Controller’s contractors, in particular where providing such data is necessary to perform the contract or other activities in the field of economic activity carried out by the Controller.

8. Your personal data shall be processed by the Controller for the duration of cooperation or the duration of the contract referred to in point 2 above, and may also be processed later, i.e. until the expiry of the limitation period for any claims and in connection with the implementation of the 5-year archiving obligation regarding documents stored for tax purposes. Your personal data processed for marketing purposes shall be processed – if the basis for processing is consent – until the consent is withdrawn, in other regards – until the end of the marketing campaign or until objection to data processing.

9. You have the right to request:
a. access to your personal data,
b. rectification of your personal data,
c. erasure of your personal data (the right to be forgotten),
d. restriction of your personal data.

10. Moreover, you have the right to object to processing your personal data on grounds relating to your particular situation.

11. If your personal data is processed under your consent, you also have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

12. You have the right to lodge a complaint with a supervisory authority – in Poland it’s: the President of the Data Protection Office.

13. There will be no automated decision-making, including profiling, as regards to your personal data.

INFORMATION FOR SENDERS AND RECIPIENTS OF TRANSPORT SHIPMENTS AND LOADS WHO ARE NOT THE CUSTOMERS OF “ATF – HEAVY TRANSPORT” ADAM FIJAŁ

Pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing f personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) we inform that:

2. Your personal data is being received from you or was provided by the entity that orders the Controller the performance of a transport/forwarding service.

3. The Controller receives the data necessary to provide the transport/forwarding services, including: basic personal data (name, surname), delivery/pickup address, data of the entity (when the transport service is realized for business entity) and other data concerning the transport, including data necessary to complete the consignment note/CMR document in accordance with applicable law, contact details.

4. Your personal data shall be processed in accordance with Article 6.1. (f) of the GDPR – which means that processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party; the legitimate interests include: the need to carry out the transport/forwarding contract, as well as the establishment, exercise or defence of legal claims.

5. Providing your personal data is voluntary, but necessary to perform a transport service. Refusal to provide personal data may hinder performance of the service referred to in the previous sentence.

6. The recipient of your personal data: entities providing electronic mail hosting services, entities providing IT services, entities providing consultancy services for the Controller, including legal, tax, auditing advice, other Controller’s contractors, in particular where providing such data is necessary to perform the contract or other activities in the field of economic activity carried out by the Controller.

7. Your personal data shall be processed by the Controller for the duration of the performance of the transport/forwarding service and may also be processed later, i.e. until the expiry of the limitation period for any claims and in connection with the implementation of the 5-year archiving obligation regarding documents stored for tax purposes.

8. You have the right to request:
a. access to your personal data,
b. rectification of your personal data,
c. erasure of your personal data (the right to be forgotten),
d. restriction of your personal data.
